ATTORNEY FEES
A contingent fee is one in which the lawyer takes a percentage of the judgment or recovery as a fee. Our usual contingent fees range from 33 1/3% to 50%, depending on several factors including the amount involved and how we assess the risk in the case, and depending on the facts of the particular case. If you do not recover anything then you owe us nothing. In a contingent fee arrangement, the lawyer assumes the entire risk of out of pocket loss for his fees, the major expense in most lawsuits. Typically, the client pays for court costs and any expert fees. In those cases where we advance all costs, the client does not risk spending money for court costs, expert fees, attorney's fees or other expenses of litigation unless there is a recovery. Any medical expenses are the sold responsibility of the client.
An hourly-fee is one where the lawyer's fee is determined by the amount of time spent on your case. In an hourly fee arrangement, the client assumes the risk and pays all court costs, attorney's fees, expert fees and other expenses.
An hourly rate is appropriate for most types of cases and mandatory in the case of family law matters. We will discuss performing most any case on a contingent fee basis, other than a family law matter, but typically the a contingent fee must provide the opportunity for a larger fee to warrant it. Except as otherwise agreed, in contingent fee cases, there is no attorney’s fees unless you recover. Court costs and litigation expenses are paid by the client. Any medical costs are the sole responsibility of the client. No contingent fees in Family Law Matters.
